Repeat offender penalties
Both DUIs and DWIs incur elevated penalties on second and subsequent offenses. A subsequent offense within five years of a previous offense means you will face license suspension for a period of one year. Additionally, you will need to have an ignition interlock device installed on your vehicle for a year after the suspension period ends. These devices require drivers to submit a breathalyzer before starting their vehicle.

Alcohol restrictions stipulate that driving with any level of alcohol in the blood is a criminal offense, even if the amount is less than the legal limit of .08% blood alcohol content. Alcohol restrictions occur after previous drunk driving convictions. They also apply to drivers under 21. License restriction violations result in additional penalties beyond what already accompanied your conviction.
With license restrictions, drivers must submit to alcohol testing as requested by law enforcement. Refusal of the test will also result in additional penalties, as will refusal of initial alcohol testing. In the latter case, law enforcement will confiscate your license and issue an Order of Suspension.
